En validant sa commande, le client reconnaît qu’il n’est pas nécessaire de signer physiquement ce document pour que les conditions s’appliquent.

The Guédelon online shop provides the following information:
– legal information about GUEDELON
– description of the essential characteristics of the products
– prices in euros and, where applicable, delivery charges
– terms of payment, delivery and performance
– right of withdrawal
– period of validity of offers and prices
– conditions for terminating contracts for an indefinite period or for more than one year

All this information is available in French. The customer certifies that he/she has the legal capacity to commit to these conditions.


article 1 – entirety : these general terms and conditions express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept unreservedly all the provisions of these general terms and conditions. No general or specific condition appearing in the documents sent or handed over by the consumer may be incorporated into these general conditions, insofar as these documents are incompatible with these general conditions.

article 2 – purpose : the purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of goods and services offered by the company GUEDELON to the consumer.

article 3 – contractual documents : this contract is formed by the following contractual documents, presented in descending hierarchical order : these general terms and conditions ; the order form. In the event of contradiction between the provisions contained in documents of different rank, the provisions of the document of higher rank shall prevail.

article 4 – entrée en vigueur – durée : les présentes conditions générales entrent en vigueur à la date de signature du bon de commande.
Les présentes conditions générales sont conclues pour la durée nécessaire à la fourniture des biens et services souscrits, jusqu’à l’extinction
des garanties dûes par la société SAS GUÉDELON.

article 5 – electronic signature : the consumer’s ‘double click’ on the order form constitutes an electronic signature which has the same value between the parties as a handwritten signature.

article 6 – order confirmation : contractual information will be confirmed by e-mail at the latest at the time of delivery or, failing that, at the address indicated by the consumer on the order form.

article 7 – proof of the transaction : the computerised registers, kept in the computer systems of the GUEDELON company under reasonable conditions of security, will be considered as proof of the communications, orders and payments made between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as proof.

article 8 – informations sur les produits
8-a : la société SAS GUÉDELON présente sur son site web les produits à vendre avec les caractéristiques nécessaires qui permettent de respecter l’Article L 111-1 du Code de la consommation, qui prévoit la possibilité pour le consommateur potentiel de connaître avant la prise de commande définitive les caractéristiques essentielles des produits qu’il souhaite acheter.
8-b : les offres présentées par la société SAS GUÉDELON ne sont valables que dans la limite des stocks disponibles.

article 9 – prices : prices are indicated in euros and are valid only on the date the order form is sent by the customer. They do not include delivery charges, which are invoiced in addition and indicated before the order is validated. Prices include VAT applicable on the date of the order, and any change in the applicable VAT rate will be automatically reflected in the price of products in the online store.
Payment in full must be made at the time of ordering. At no time may the sums paid be considered as deposits or advance payments.

article 10 – methods of payment : to pay for the order, the consumer has a choice of all the methods of payment indicated on the order form. The consumer guarantees GUEDELON that he/she has the necessary authorizations to use the method of payment chosen by him/her when validating the order form.
GUEDELON reserves the right to suspend all order processing and deliveries in the event of refusal to authorize payment by credit card by officially accredited organizations or in the event of non-payment. In particular, GUEDELON reserves the right to refuse to make a delivery or to honour an order from a consumer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress. GUEDELON has implemented an order verification procedure designed to ensure that no person uses another person’s bank details without their knowledge. As part of this verification, the customer will be asked to send GUEDELON a copy of an identity document and proof of address. The order will be validated only after receipt and verification by our services of the documents sent.

article 11 – availability of products : the order will be executed at the latest within 3 days from the day following that on which the consumer placed the order. In the event of unavailability of the product ordered, particularly due to our suppliers, the consumer will be informed as soon as possible and will have the option of cancelling the order. The consumer will then have the choice of requesting either a refund of the sums paid within 30 days of their payment at the latest, or an exchange of the product.

article 12 – livraison : les produits sont livrés à l’adresse indiquée par le client en France métropolitaine. En cas d’absence, un avis de passage sera laissé.
The customer must check the condition of the package and report any damage to the carrier and to GUEDELON within 7 days.

La Poste : to keep transport costs to a minimum, all small and medium-sized products are sent by La Poste. As well as being cost-effective, this service delivers within 48 hours anywhere in France and gives you the option of collecting your order from a post office close to the delivery address if you are absent from the original delivery address when the postman arrives. Specifically, if you are absent on the day of delivery, your postman will leave a delivery notice in your letterbox, allowing you to collect your parcel from your post office during opening hours, within 15 days. La Poste is a very reliable service. However, as with any shipment, there may be a delay in delivery or the product may go astray. In the event of a delay in delivery in relation to the date we indicated in the dispatch email, we ask you to inform us of this delay by calling us or sending us an email. We will then contact the Post Office to start an investigation. A Post investigation can last up to 21 days from the date of the start of the investigation. If the product is found during this period, it will be sent to your home address immediately (in most cases). If, on the other hand, the product is not found at the end of the 21-day investigation period, the Post Office will consider the parcel to be lost. It is only at this point that we can send you a replacement product, at our expense. If the product(s) ordered are no longer available at that time, we will reimburse you for the amount of the products affected by the carrier’s loss. If the product(s) is/are still available, but the selling price on the site has changed, we will apply the new selling price, either by refunding you by cheque for the difference, or by requesting an additional cheque for the price difference. We accept no responsibility for longer delivery times due to the carrier, particularly in the event of loss of products or strikes.

article 13 – problèmes de livraison : toute anomalie concernant la livraison (avarie, produit manquant par rapport au bon de livraison, colis endommagé, produits cassés…) devra être impérativement indiquée sur le bon de livraison sous forme de “réserves manuscrites”, accompagnée de la signature du client. Le consommateur devra parallèlement confirmer cette anomalie en adressant au transporteur dans les deux (2) jours ouvrables suivants la date de livraison un courrier recommandé avec accusé de réception exposant lesdites réclamations.

article 14 – erreurs de livraison :
14-a : le consommateur devra formuler auprès de la société SAS GUÉDELON le jour même de la livraison ou au plus tard le premier jour ouvré suivant la livraison, toute réclamation d’erreur de livraison. Toute réclamation formulée au delà de ce délai sera rejetée.
14-b : la formulation de cette réclamation auprès de la société SAS GUÉDELON pourra être faite par téléphone au +33(0)3 86 45 66 66 du lundi au vendredi de 9h à 16h
ou par mail à : boutique@guedelon.fr
14-c : toute réclamation non effectuée dans les règles définies ci-dessus et dans les délais impartis ne pourra être prise en compte et dégagera la société GUEDELON de toute responsabilité vis à vis du consommateur.
14-d : en cas d’erreur de livraison, tout produit à échanger ou à rembourser devra être retourné à la société GUEDELON dans son ensemble et dans son emballage d’origine, en Colissimo Recommandé, à l’adresse suivante : Guédelon D 955 89520 TREIGNY

article 15 – guarantee : the products are covered by the legal guarantee against hidden defects. As GUEDELON is not the manufacturer, only the manufacturer’s liability may be incurred.

article 16 – returns and refunds : the Guédelon online shop does not accept returns or refunds, regardless of the nature of the product ordered.
16-a : Guédelon decline all responsibility for breakage during transport. We take care to pack each item carefully, but it is the carrier’s responsibility to ensure delivery in good condition.
16-b : please consult the size guide carefully before purchasing, as no exchanges will be possible.

article 17 – rights of use : the right to use GUEDELON software, as well as software distributed by GUEDELON, is granted to the consumer on a non-exclusive, personal and non-transferable basis, in accordance with the French Intellectual Property Code. However, in accordance with Article L122-6-1 of this Code, the consumer has the right to reproduce the software exclusively for the purpose of making a backup copy, where this is necessary to preserve the use of the software. In any event, the author of the software retains a property right in his work, which the consumer undertakes to respect.

article 18 – force majeure : neither party will have failed to fulfil its contractual obligations insofar as their performance is delayed, hindered or prevented by an act of God or force majeure. The term ‘fortuitous event’ or ‘force majeure’ shall be taken to mean any facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the parties, despite all reasonable efforts to do so. The party affected by such circumstances will notify the other within ten working days of becoming aware of the circumstances. The two parties will then meet, within a period of one month, unless this is impossible due to force majeure, to examine the impact of the event and agree the conditions under which performance of the contract will continue. If the case of force majeure lasts for more than three months, these general terms and conditions may be terminated by the injured party. The following are considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals: blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning; stoppage of telecommunications networks or difficulties specific to telecommunications networks external to customers.

article 19 – partial non-validation : if one or more stipulations of these general terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

article 20 – non-waiver : the fact that one of the parties does not take advantage of a breach by the other party of any of the obligations referred to in these general terms and conditions cannot be interpreted for the future as a waiver of the obligation in question.

article 21 – title : in the event of any difficulty of interpretation between any of the titles appearing at the head of the clauses and any of the clauses, the titles will be declared non-existent.

article 22 – applicable law : These general terms and conditions are governed by French law. This applies to both substantive and formal rules. In the event of a dispute or claim, the consumer will first contact the company GUEDELON to obtain an amicable solution.
Secondly, in the event of an appeal, consumers can submit a complaint to , via its dedicated dialogue box.

article 23 – informatique et libertés : les informations qui sont demandées au consommateur sont nécessaires au traitement de sa commande et pourront être communiquées aux partenaires contractuels de la société SAS GUEDELON intervenant dans le cadre de l’exécution de cette commande. Le consommateur peut écrire à la société GUEDELON dont les coordonnées sont au sein de la charte de confidentialité figurant dans le cadre du site web, pour s’opposer à une telle communication, ou pour exercer ses droits d’accès, de rectification à l’égard des informations le concernant et figurant dans les fichiers de la société GUEDELON, dans les conditions prévues par la loi du 6 janvier 1978.
